Welcome to Buyments.com ("Buyments", "we", "us", "our"). These Terms & Conditions ("Terms") govern your access to and use of the Buyments platform, websites, mobile interfaces, and any services offered by Buyments in the State of Kuwait. By creating an account, subscribing to a plan, or using any part of the service, you agree to be bound by these Terms.
Buyments is a Software-as-a-Service platform that enables Kuwaiti merchants to accept online payments, operate online stores, and engage customers. The service includes, without limitation:
You must be at least 18 years old and legally able to enter into a binding contract. To operate as a merchant you must hold a valid Kuwaiti commercial registration and complete our Know-Your-Customer (KYC) verification, which includes submitting:
Your account remains in a restricted state until your KYC submission is approved by Buyments. We may request additional information or reject applications at our sole discretion.
All payments on Buyments are processed by UPayments, our sole integrated payment gateway. Supported payment methods include K-Net, Visa, Mastercard, Apple Pay, Google Pay, Samsung Pay, and Apple Pay over K-Net. All transactions are denominated in Kuwaiti Dinar (KWD).
Buyments does not itself store card or bank credentials. Card data is collected and processed directly by UPayments under their applicable terms. Settlement of funds to your registered IBAN is performed subject to UPayments' clearing cycles and any holds, reserves, or deductions required to cover refunds, chargebacks, or investigations.

Violation of this section may result in immediate suspension, termination, withholding of settlement funds, and reporting to the competent authorities.
Customers purchasing from merchants on Buyments are entering into a direct contractual relationship with the merchant. Buyments is not a party to the sale of goods or services and does not warrant the quality, fitness, legality, or safety of merchant offerings. Refund, exchange, and delivery policies are set and enforced by the merchant, subject to Kuwaiti consumer protection law.
Merchants may send WhatsApp marketing campaigns and notifications to customers who have shared their phone number through the platform. Merchants are responsible for ensuring they have valid consent under Meta / WhatsApp Business policy and applicable law. Buyments may rate-limit, audit, or suspend messaging activity that violates these policies.
The Buyments platform, including its software, design, trademarks, and content, is owned by Buyments and protected by applicable laws. Merchants retain ownership of the content they upload (products, images, descriptions) and grant Buyments a non-exclusive licence to host, display, and process such content strictly for the purpose of providing the service.
We may suspend or terminate your access to the service, without prior notice where appropriate, if you breach these Terms, fail KYC, engage in prohibited conduct, expose us or our partners to legal or regulatory risk, or if required to comply with a lawful order. You may terminate your account at any time; paid subscriptions remain non-refundable as set out in Section 4.
The service is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free, or free of security vulnerabilities. To the maximum extent permitted by law, Buyments disclaims all implied warranties.
To the fullest extent permitted by Kuwaiti law, Buyments' aggregate liability arising out of or relating to these Terms or the service shall not exceed the fees you paid to Buyments in the three (3) months preceding the event giving rise to the claim. Buyments shall not be liable for indirect, incidental, consequential, or loss-of-profits damages.
You agree to indemnify and hold Buyments harmless from any claim, loss, or expense arising out of your use of the service, your products or services sold through the platform, your violation of these Terms, or your violation of any law or third-party right.
We may update these Terms from time to time. Material changes will be communicated through the platform or by email. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Kuwait. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Kuwait.
